Terms of use
Last updated: 16/10/2026
1. Scope of the agreement
These terms of use ("the Agreement") govern your use of makeo's AI-assisted email service ("the Service"), provided by makeo ("we", "us", "makeo").
By creating an account and using the Service you accept these terms. If you do not accept them, you must not use the Service.
The Agreement takes effect when you sign up and remains in force until your account is terminated.
2. The Service
makeo is an AI-assisted email service that helps you organize, reply to, and write email. The Service connects to your mail accounts and processes email in real time. We do not store your emails on our servers.
The Service may include functionality for recording and transcribing meetings. If you use any recording or transcription feature, you are SOLELY responsible for informing all meeting participants that a recording is taking place and for obtaining their explicit consent prior to recording. makeo accepts no liability whatsoever for recordings made without the consent of all participants.
We aim to keep the Service available 24/7, but planned or unplanned maintenance may cause short periods of downtime. We do not warrant uninterrupted, error-free, or virus-free operation.
3. Account and responsibility
You are responsible for keeping your login credentials secure and for all activity on your account. You must provide accurate and complete information when registering.
You are solely responsible for all content sent through the Service, including but not limited to AI-assisted emails. While the Service may draft, suggest, or generate content on your behalf, the final decision to send any communication rests entirely with you. makeo is not responsible for the content, accuracy, or consequences of messages you choose to send.
4. Eligibility
The Service is intended for individuals who are at least 16 years of age. By using the Service you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into this Agreement. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to this Agreement.
5. Acceptable use
You agree not to use the Service to:
- Send spam, unsolicited bulk messages, or distribute malware, viruses, or other harmful code;
- Transmit any content that is unlawful, threatening, defamatory, obscene, discriminatory, or otherwise objectionable;
- Infringe any third party's intellectual property rights, including copyrights, trademarks, patents, or trade secrets;
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
- Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service;
- Use the Service to build a competing product or service, or copy any feature or functionality of the Service;
- Resell, sublicense, or otherwise make the Service available to any third party without our prior written consent.
We reserve the right to suspend or terminate your access to the Service without prior notice if we reasonably believe you have violated any of these restrictions.
6. Payment, trial, and automatic renewal
Starter starts at $14.50/user/month, Growth starts at $24.50/user/month, Pro starts at $39.50/user/month. When you sign up you add a payment card. You receive a 7-day free trial. Your card will not be charged during the trial period.
After the trial the subscription renews automatically each month, and the applicable monthly amount is charged to the payment method on file. The subscription will continue to renew automatically until you cancel.
You may cancel at any time — there is no minimum term. On cancellation you retain access until the end of the current paid billing period. No refunds are provided for partial months.
We reserve the right to change prices with 30 days' notice. Continued use after a price change constitutes acceptance.
7. Cancellation and termination
You may cancel your subscription at any time via settings. You may also permanently delete your account. On deletion all your data is removed from our systems.
We may terminate or suspend your account immediately, without prior notice or liability, if: (a) you breach any provision of this Agreement; (b) you misuse the Service; (c) we are required to do so by law; or (d) continued provision of the Service to you is no longer commercially viable.
Upon termination, all licences and rights granted to you under this Agreement shall cease immediately. You will no longer have access to the Service or any data associated with your account.
8. Intellectual property
makeo and the Service, including design, logo, code, and documentation, belong to makeo or our licensors. You receive only a non-exclusive, non-transferable, revocable, limited right to use the Service in accordance with the Agreement.
You must not copy, modify, reverse engineer, or distribute the Service or any part of it without written permission.
If you provide us with any feedback, suggestions, or ideas regarding the Service, you grant makeo an unrestricted, perpetual, irrevocable, royalty-free licence to use, modify, publish, distribute, and otherwise exploit such feedback for any purpose without any obligation or compensation to you.
9. AI-generated content — disclaimer and your responsibility
The Service uses artificial intelligence to generate, suggest, and organise email content. You acknowledge and agree that:
- AI output is probabilistic in nature and may contain factual errors, omissions, inconsistencies, or content that is otherwise inaccurate or incomplete;
- You are solely responsible for reviewing, verifying, and approving all AI-generated content before it is sent or otherwise acted upon;
- makeo makes no warranty, express or implied, regarding the accuracy, completeness, reliability, or fitness for any particular purpose of any AI-generated output;
- makeo shall not be liable for any decisions, actions, or omissions made in reliance on AI-generated output;
- You must not rely on AI-generated output as a substitute for professional legal, medical, financial, or other specialist advice.
Your email content and personal data are never used to train, fine-tune, or improve any machine learning models, whether our own or those of any third party. AI processing is performed solely to deliver the Service to you in real time.
10. Data protection
makeo is built with a "Privacy by Design" architecture that meets the strictest EU requirements for processing data for both individuals and businesses. Our detailed handling of your personal data is described in our Privacy policy.
10.1 OAuth 2.0 & token-based access
We never access your passwords. Connection to your mail accounts is established via official API integrations (OAuth 2.0), where makeo only receives an encrypted access token. You retain full control and may revoke access at any time directly with your mail provider.
10.2 Isolated account segmentation
Each mail account is processed in a closed, sandboxed environment. This ensures strict access control and reduces the risk of data leakage across accounts or users.
10.3 Encryption
All tokens and metadata are protected with AES-256-GCM encryption (at rest). All communication between your browser, makeo, and mail servers uses TLS 1.3 (in transit).
10.4 EU hosting (GDPR compliance)
All processing and storage takes place on servers located within the EU. We comply with the requirements of the General Data Protection Regulation (GDPR), so your data does not leave European jurisdiction without your explicit consent.
10.5 Zero-persistence policy
Email content is not stored permanently on our servers. Data is retrieved only in real time via secure API calls for analysis and generation, after which it is cleared from active memory.
10.6 HIPAA & HITECH readiness
makeo offers execution of a Business Associate Agreement (BAA), which is intended to support handling of sensitive personal health information (PHI) in line with applicable international security standards.
11. Third-party services
The Service relies on third-party infrastructure for hosting, payment processing, email connectivity, and AI processing. All third-party providers are bound by appropriate data processing agreements.
makeo is not responsible for failures, interruptions, or limitations caused by third-party services that are beyond our reasonable control.
12. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the Service, including but not limited to business plans, technical data, product ideas, and customer information. Confidential information shall not be disclosed to third parties or used for any purpose other than the performance of this Agreement without the disclosing party's prior written consent.
The obligations set out in this section shall survive for a period of three (3) years after the termination of this Agreement.
13. Limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAKEMORE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages of any kind;
- Loss of profit, revenue, data, business opportunities, or goodwill;
- Any actions taken, or not taken, based on AI-generated output;
- Unauthorized access to or alteration of your data by third parties;
- Failures or interruptions of the internet, telecommunications networks, or other infrastructure outside our control.
In no event shall makeo's total aggregate liability arising out of or in connection with this Agreement or the Service exceed the greater of: (a) the total fees paid by you to makeo in the six (6) months immediately preceding the event giving rise to the claim; or (b) DKK 1,000.
14. Indemnification
You agree to defend, indemnify, and hold harmless makeo, its officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of, or inability to use, the Service;
- Your breach of any provision of this Agreement;
- Content you send, submit, or otherwise transmit through the Service;
- Your failure to obtain proper consent for meeting recordings or transcriptions;
- Your violation of any applicable law or the rights of any third party.
15. Force majeure
Neither party shall be liable for any failure or delay in the performance of its obligations under this Agreement where such failure or delay results from circumstances beyond that party's reasonable control, including but not limited to: natural disasters, epidemics or pandemics, acts of war or terrorism, government sanctions or embargoes, strikes or labour disputes, power outages, internet or telecommunications failures, cyberattacks, or failures of third-party service providers.
If a force majeure event continues for more than ninety (90) consecutive days, either party may terminate this Agreement by providing written notice to the other party.
16. Export compliance and sanctions
You represent and warrant that you are not located in, or a national or resident of, any country subject to trade sanctions or export restrictions. You agree to comply with all applicable export control laws and regulations in connection with your use of the Service. You may not use the Service in any manner that would violate any applicable trade sanction, embargo, or export restriction.
17. Dispute resolution
This Agreement is governed by Danish law. The parties agree to attempt to resolve any dispute arising out of or in connection with this Agreement through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days of written notice, it shall be submitted to the exclusive jurisdiction of the Danish courts, with Copenhagen City Court as the court of first instance.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST MAKEMORE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT.
18. Changes to these terms
We may change these terms. Material changes will be notified by email or in the Service with at least 30 days' notice. Continued use constitutes acceptance of the new terms. If you do not accept, you may cancel before they take effect.
19. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be deemed severed from this Agreement. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
20. Entire agreement
This Agreement, together with the Privacy policy, constitutes the entire agreement between you and makeo with respect to the Service and supersedes all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and makeo regarding the subject matter hereof.
21. Assignment
You may not assign, transfer, or delegate any of your rights or obligations under this Agreement without makeo's prior written consent. makeo may freely assign this Agreement in connection with a merger, acquisition, corporate reorganisation, or sale of all or substantially all of its assets without your consent.
22. No partnership or agency
Nothing in this Agreement shall be construed to create a partnership, joint venture, employment relationship, or agency between you and makeo. Neither party has the authority to bind or obligate the other in any manner.
23. Waiver
The failure of makeo to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. A waiver of any default shall not constitute a waiver of any subsequent default.
